What will HB 208 do?

It will criminalize mere possession of any firearm, by a law-abiding citizen, for the first time ever in New Hampshire history! A law-abiding person - with no ill-intent towards anyone, who steps on the wrong piece
of land, while carrying a firearm - could go to jail under HB 208.

HB-208’s “exemptions” may sound “nice”, but they have a hidden, nasty sting. For example: HB 208 will not apply to possession of a firearm, “by an individual over 18 years of age not currently enrolled in grades
kindergarten through 12 who holds a valid permit issued under RSA 159:6 and who is operating or attending a motor vehicle.” This will convert our carry license into a FIREARMS POSSESSION LICENSE FOR EVERY FIREARM!! The reason: every firearm-owner will have to get a carry license, to ensure that he cannot be arrested, as a result of innocently straying into a “school” zone.

HB208 will eliminate open carry in most of NH. School buses are included in the definition of a “safe school zone.” School buses move. A lot. A hunter afield in a very rural area, who has no concealed carry license,
could be jailed just for having a loaded shotgun on land owned by a school. A 17 year-old out hunting, who does not have a carry license and who crosses a school-owned field – even when school is not in session – could be prosecuted.

HB 208 provides that: “such prohibitions by school authorities [shall be] posted in conspicuous locations on school property.” This exemption is a snare. An anti-gun judge could use the vague term “conspicuous
locations on school property” to make a criminal of a law-abiding person. The accused must still go to Court, with a lawyer, to show the proper notice was not posted. A 16 year-old must get a hunting license.  If that student, planning to hunt on the way home from school, parks in the school parking lot, with his shotgun secured in the car’s trunk, he’ll have committed a crime. Decent, law-abiding folks will be prosecuted, and forced to spend huge sums, to stay out of prison.

HB 208 mandates that any firearm must be, “locked and not visible in a motor vehicle.” Many popular SUVs and pick-ups do not have a trunk. Leaving your hunting shotgun or rifle in a standard zippered case could land you in prison.

HB 208 Sponsors conceal a key fact. Assault – with a firearm or a fist – has for centuries been a crime. Anyone, who brings a firearm to school to do harm, can be arrested and prosecuted RIGHT NOW.

There will be a hearing for HB 208 on Tuesday January 25th, 2005 at 11 am before the Criminal Justice and Public Safety Committee in room 204 of the Legislative Office Building which is located directly behind the State House.

Call the committee members and come to the hearing.
