I have some disappointing news to report.

After the hearing on our bill to strengthen Preemption (HB 334), the Senate Judiciary Committee voted to recommend our bill be sent to “interim study”. You and I both know that “study” is a polite way of killing the bill.

I told you Tuesday that I was afraid some of the Senators were wavering on supporting preemption.

Unfortunately my fears proved correct. Despite making a written promise to you in their New Hampshire Firearms Coalition candidate survey to support strengthening NH’s Preemption Law, Senators Jim Luther and Fenton Groen sided with the bureaucrats to vote to kill this important bill.

They voted to continue to let un-elected bureaucrats across the Granite State to disarm you at a whim.

What is more, I have received word they are going to sell you out again when it comes time to vote on Constitutional Carry. My sources are telling me they plan to significantly gut Constitutional Carry, (HB 536).

Call or email Senators Fenton Groen (603) 817-9352 / fenton.groen@leg.state.nh.us and Jim Luther (603) 465-3471 / jim.luther@leg.state.nh.us, let them know how disappointed you are that they broke their promise to you so they could side with anti-gun bureaucrats.

When they were seeking your vote, they promised they would support your right to bear arms, and prevent gun-grabbing bureaucrats from disarming you.

But, when push came to shove they deserted us.

On top of that, despite promising to repeal the ban on having a loaded long-gun in your vehicle, they caved under pressure from Law-enforcement and voted to kill a bill that would have done just that.

After they have broken their promises on both these bills, I know I cannot count on them to do the right thing and support Constitutional Carry without amendment.

While the vote on preemption still must be approved by the full Senate, I am concerned that unless we put the pressure on Senators Groen and Luther right away, Constitutional Carry will suffer a similar fate.

Please call or email Senators Fenton Groen (603) 817-9352 / fenton.groen@leg.state.nh.us and Jim Luther (603) 465-3471 / jim.luther@leg.state.nh.us, tell them how disappointed you are to learn that their word means nothing. Tell them you expect them to do the right thing when they vote on Constitutional Carry.

If you and I allow this betrayal to go unchallenged, our chance at passing Constitutional Carry will go right out the window.

The Senate Committee could vote at any time, and that is why I need you to act right now.

I told you yesterday I would give you more information today about the upcoming hearing on Constitutional Carry (HB 536) and Preemption (HB 334).

Two weeks ago, the House passed both these bills.

The hearings in the Senate, scheduled for this Thursday at 1:00 and 2:00, haven’t even been held yet, and already I am hearing reports that the Senate is working hard to kill one and gut the other.

Sources in Concord are telling me that many Senators are only willing to vote in favor of one pro-gun bill this year, and that they want that bill gutted before they will do even that.

Last year, when we were working on Constitutional Carry attempts were made to add more stringent background checks, impose redundant state versions of federal standards for carrying, and gut the Second Amendment rights of young people.

My sources are telling me all that and more is on the table to bring back to gut HB 536.

As introduced, HB 536 would have cut red tape for the existing licensing system for those who still wish to get one for reciprocity.

Unfortunately, the House stripped out those provision.

If the Senate takes anything else out, there will be nothing worth passing left.

This is not acceptable.

The good news is that three of the five Judiciary Committee members signed the 2010 New Hampshire Firearms Coalition’s survey pledging their support to Constitutional Carry.

Unfortunately, I am already getting reports that several of those Senators are starting to cave under the pressure from leadership to gut this bill.

They need to be reminded of their promise to their Constituents.

Call or email Senators Fenton Groen (603) 271-2609/ fenton.groen@leg.state.nh.us, Jim Luther (603) 271-4151 jim.luther@leg.state.nh.us, and James Forsythe (603) 271-3067 james.forsythe@leg.state.nh.us and remind them of their commitment to support Constitutional Carry, and tell them you want HB 536 passed without any amendments that would weaken the bill.

On top of that, Senator Sharon Carson stands out as the only Republican on the committee who did not answer the NHFC Survey.

What’s more — she signed on to an earlier version of the bill that would have eliminated the issuance of out-of-state licenses all together!

Call Senator Sharon Carson at (603) 271-1403 or email her at sharon.carson@leg.state.nh.us. Tell her to support Constitutional Carry — HB-536 — with absolutely NO amendments that would weaken the bill.

Tell her law abiding citizens should not need government “permission” to exercise their rights.

This is a big week for Gun Rights in New Hampshire. Neighboring Vermont has always had the Constitutional Carry standard, and now the Granite State is this close to having it as well.

This is so important, Dudley Brown, Executive Director of the National Association for Gun Rights, will be personally attending, at the request of NHFC, to help support passage of this important piece of Legislation.

Thursday’s hearings begins at 2:00.

Won’t you join Dudley and I as we stand against the anti-gunners who would gut and kill this bill?

Mark your calendar and join me in the fight against the anti-gunner politicians at the Capitol on Thursday!

I wish I could tell you it is just HB 536 that is in danger.

Unfortunately, my sources are telling me that HB 334 may be in even more danger of being killed.

Right now, Senators are getting a lot of pressure from the un-elected bureaucrats in the University System of NH to either kill this bill or grant the university an exception, and it looks like Senate leadership is willing to go along with them.

After the recent court ruling sanctioning the University’s illegal gun ban, it is more critical than ever that we pass this bill.

Faculty, Parents, students, even visitors watching a UNH Hockey game are stripped of their right to defend themselves when they come onto the campus of a state run university.

That is unjust, and unconstitutional.

NH citizens should should not be stripped of their right to defend themselves on a facility funded by your tax dollars.

Thankfully, Senators Groen, Luther, and Forsythe also pledged their support for strengthening preemption, so that only the legislature, after the full legislative process, with input from you, would have the authority to regulate firearms.

However, sources are telling me that a call from you would really help them do the right thing, and vote for HB 334.

When you call or email Senators Fenton Groen (603) 271-2609 / fenton.groen@leg.state.nh.us, Jim Luther (603) 271-4151 / jim.luther@leg.state.nh.us, and James Forsythe (603) 271-3067 / james.forsythe@leg.state.nh.us about HB 536, please thank them for their pledge to support stronger preemption and ask them to keep their commitment by supporting HB 334 as passed by the House.

Unfortunately the last Republican Senator on the Committee has not pledged that same support. It is crucial that you and I contact her, letting her know we will not tolerate un-elected bureaucrats stripping away our rights to defend ourselves.

And when you call Senator Carson (603) 271-1403 or email her at sharon.carson@leg.state.nh.us, tell her you want her unconditional support of HB 334 as passed by the House.

We can still make a difference and get these important pieces of legislation passed, but I can’t do it alone.

Your help will be crucial in getting these bills through the Senate.

Call the Senators today, and if you can, join me Thursday, at 1:00 (HB 334) and 2:00 (HB 536)

This week is a big week for firearms owners.

There are nine firearms related bills having hearings this week.

Several very important bills have hearings in the Senate on Thursday, including Constitutional Carry and Preemption (and I will give you more information about those hearings tomorrow), but one bill being heard tomorrow before the House Criminal Justice and Public Safety committee will eliminate the effective ban on backyard shooting ranges.

You see, under current law, it is illegal to discharge a firearm in the “compact part of a town.”

But that doesn’t even reveal half the story.

Unfortunately, the definition of “compact part” includes a vast portion of this state, even some of the most remote parts of New Hampshire’s cities and towns. Any area where 6 or more houses are within 300 feet each other is consider a “compact part” of the town.

Not even the landowner can give permission to shoot there.

What is the only way around this law? Go crawling to the police chief, and hope he will give you written permission to shoot in your own backyard.

Supporters of the current law regularly say it is about safety, but the reality is that the current law has very little to do with safety.

The current law doesn’t prevent unsafe shooting, it prohibits all shooting.

There are other statutes to deal with a person who endangers others by willfully shooting in an unsafe manner.

An individual with 25 acres behind his house, who has 5 or more neighbors who are within 300 feet of each other, but all close to the street, could very safely shoot in his backyard, but this law still prevents him from doing so.

Not only that, but even an indoor range, properly set up, is prohibited by this statute, unless the chief of police decides to allow it.

What’s more, if someone can manage to get their police chief to approve their range, nothing prohibits a new chief from deciding he doesn’t like guns, and revoking the permission granted.

Imagine trying to run an indoor range as a business with the specter of being shut down looming each time the police chief changes?

Even defensive use of a firearm is a crime under this law if your life is not immediate danger.

Have a rabid coon wandering around your yard? If you live in a “compact part” of a town, it is a crime to shoot it, unless you meet the very high burden of proving fear of imminent serious bodily injury or death.

It is time for this law to be repealed.

And that is exactly what HB 1341 does.

NHFC has tried to get this law repealed in the past, but when the Democrats were in control of the legislature, several Republicans helped them gut the bill, specifically allowing warrant-less inspections of your backyard range.

NHFC was able to get that good bill gone bad killed, but some of those same Republicans who helped gut that bill two years ago are still on the committee hearing the bill tomorrow.

I don’t want our good bill to be gutted again this year.

That is why I need your help.

I need you to call and/or email the committee members, tell them you want them to recommend passage of this bill, without amendment.

Earlier today I told you about an attempt to kill HB 536, and asked you to call Rep. Elaine Swinford and tell her to back down.

Fortunately, we were given a reprieve, but not for long.

Your see, the House, unexpectedly, did not get to HB 536 during its business today, so you have more time to contact your legislators, and tell them you want Constitutional Carry passed, right now, without any more amendments to weaken it.

There is still a chance we can pass this bill.

But I need you to act immediately.

I expect HB 536 will be the second bill the legislature will be voting on tomorrow.

Every vote is going to count, that is why I need you help right now.

As you know, if passed, HB 536 would restore the right of every law-abiding New Hampshire citizen to carry a gun to protect themselves and their families — WITHOUT going through a bunch of bureaucratic rigmarole!

In short, if you’re legally able to own a firearm, you’re legally able to carry it. Period.

No expensive permit fees.

No “Big-Brother-May-I”.

No “dangerous persons” databases.

Just a God-given right to carry a firearm… the way our founding fathers intended.

This is the way it’s done in Vermont, Alaska, Arizona, and now Wyoming.

It is time for NH to be next.

We have a chance to move this forward tomorrow, but it is not going to be easy.

Your calls and emails are working, Rep. Swinford has given indications she will back down, but you and I need to make sure that all our legislators know not to try the shenanigans she was going to pull.

You and I both know when one trick doesn’t work the gun-grabbers will use another. So while Rep. Swinford may have learned her lesson for now, it is important we don’t give any of our representatives any room to harm this important legislation.

I need you to call and/or email your representatives. Tell them you want them to support HB 536, and not allow any amendments to weaken the bill.

Make sure your representatives know that allowing a parliamentary trick to kill the bill is just as anti-gun as voting against it.

Remind your representatives that you want Constitutional Carry passed now!

I do have some good new, the other bill I told you about yesterday, HB 334, preemption of local regulations, passed the House 180-144.

But, with the governor threatening a veto of both HB 334 and HB 536, it is going to be imperative that we get a stronger showing in support of HB 536 tomorrow.

That is why it is absolutely critical that you call and/or email your representatives today!

Sincerely,

P.S. The legislature will be voting on Constitutional Carry (HB 536) tomorrow. Your help is needed for it to pass.

We have several opportunities to advance gun rights in the next two days.

But I need you to act now.

Last year the legislature held several key bills over the summer, and they will be voting on them tomorrow and Thursday.

One of the most important bills for firearms rights is HB 536, Constitutional carry.

I have some good news to report.

The committee recommended passage of HB 536, and the full house will be voting on that recommendation tomorrow.

Unfortunately, the committee also stripped stripped most of the additional protections that were in HB 536. What is left is Constitutional Carry, but that is all.

There is still a chance you and I can get some of those additional protections back.

This is where you come in.

I need you to call and/or email your representatives. Tell them you want
them to support HB 536, and support any amendment that restores the
protections found in the original bill.

Even if we are unsuccessful in getting the additional protections put back into the bill (stiff penalties for police chiefs refusing to issue a license that is required, clarifying that only those prohibited from possessing a firearm are ineligible for a license), by fighting to restore the additional protections found in the original HB 536, we put the legislature on notice that we will not tolerate our legislation
being gutted, and help to ensure it is not weakened further.

So please call and/or email your representative today.

The other important bill being voted on tomorrow is HB 334, preemption of local gun regulation. HB 334 prohibits towns, cities, or other governmental agencies from making their own regulations of firearms.

If HB 334 passes, instead of having your rights threatened by every town and city in the state, not to mention the bureaucracy of just about any state agency, the only body in the state that will have the power to regulate firearms will be the legislature, where you and I can have a say, and stop unconstitutional restrictions on your rights.

When NHFC asked for this legislation last year, we knew it would be an important piece of legislation, but only recently has its true urgency become apparent.

You see, NH already has a law similar to this; NHFC requested HB 334 in an effort to clarify and strengthen these provisions.

Recently, despite the current law that prevents them from doing so, the University of NH attempted to enforce their illegal ban on firearms, and was actually able to obtain a court order against several individuals, preventing those individuals from carrying on a UNH campus.

This bill will make clear that UNH and the Community Colleges do not have the authority to ban firearms on their campuses.

But they are putting up a fight.

UNH has asked for an exemption to HB 334, and it is going to be up to you and I to make sure they do not get it.

I need you to call and/or email your representatives today, insist they do not support any attempt to weaken or provide any exemptions to HB 334.

You and I can see these important bills passed, but it is critical that we act now.

Please call and/or email your representatives today. Tell them to restore the additional protections found in the original HB 536, and tell them to not support any amendment to HB 334 that weakens it or provide any exceptions for UNH, or any other entity for that matter.

Sincerely,

Jonathan R. Evans, Esq.
President, NHFC

P.S. The legislature will be voting on two very important bills tomorrow, Constitutional Carry (HB 536) and Preemption of local gun regulations (HB 334). Your help is needed to pass them.

Email and/or call your representatives, tell them to pass HB 536 and HB 334. Tell them you want HB 536 restored to it original as introduced version, and that you want them to oppose any attempts to provide exceptions to HB 334.

Good news: You did it!

Wednesday the NH House of Representatives voted to override the Governor’s veto of SB 88.

Your phone calls and emails made an impact, without them there is a very real chance this bill would have died.

I want to extend my sincerest gratitude to you for bringing us to this point.

When NHFC first championed stand your ground legislation, back in 2006, I knew it would be a tough fight, that we likely would not win right away. But you have stayed with me, consistently pressuring politicians to do the right thing on firearms legislation, and we are starting to reap the reward for our vigilance.

There is still more to do.

If you and I want to continue to advance the cause of firearms owners, we are going to have to continue the vigilance that brought us this far.

Several pieces of important legislation are scheduled to be acted upon in the next several months.

Political insiders are telling me that some politicians want this to be it. The passed this bill because they knew they had to give us something, but they don’t want to do anything else to help firearms owners this session.

You and I are going to work hard if we want to see Constitutional Carry, a stronger preemption law, or the NH Firearms Freedom act passed.

I will need you to remind politicians, voting right once will not be enough, they must vote right on every bill, every time.

On the vote on SB 88 we lost a few Representatives, with the importance of the other pieces of firearms legislation being considered over the coming months (including Constitutional Carry HB 536, Stronger Preemption HB 334, and the NH Firearms Freedom Act, HB 125), you and I will remind those Representatives who deserted us that their treasonous anti-gun votes will not be ignored, come next November.

You have achieved a great victory. In 60 days, when this new law becomes effective, you will no longer be faced with choosing between defending yourself and facing prosecution because you didn’t retreat, or turning and running from an attacker, possibly putting yourself in greater danger.

I could not have gotten here without your help.

Your vigilance in answering the call to arms whenever an important vote arose enabled this victory. I am going to need you to continue being vigilant over the coming months as we begin to deal with the rest of these bills.

You are what makes the New Hampshire Firearms Coalition the strong advocate for the rights of firearms owners that it is; I am glad to know I can count on you to continue to press on to roll back the gun-grabbers restrictions on your right to keep and bear arms.

In Liberty,

Jonathan R. Evans, Esq.
President, NHFC

PS. We have won a great victory here, but you and I must remain vigilant and continue to work hard to make sure the politicians do the right thing over the next few months, as several important bills are under consideration.

As you know, the New Hampshire Firearms Coalition relies on the generosity of its members, I know everyone can’t give every time I ask, but if you can afford to chip in $15, $20, or even just $10, it will make a difference in the fight to roll back more restrictions on your right to keep and bear arms.

I have good news to report; last Wednesday the Senate voted to overturn the Governor’s veto of SB 88.

Your phone calls and emails were instrumental in making sure that Senators didn’t cave to the pressure from the gun grabbers.

There is only one hurdle left.

The House still has to vote to override the Governor’s veto before SB 88 can become law.

SB 88 ends the requirement to retreat in the face of an attack anyplace you have a right to be.

Imagine walking out of the grocery store with your children in tow and, suddenly, a man steps out of the shadows, charges towards you, pulls a knife, and demands your money.

Imagine your wife or daughter returning to her car from the Mall of NH when a man runs up to her swinging a baseball bat and demanding she get in his car.

Imagine walking to your car after a hockey game at the Verizon Arena, and two men pop out from behind a car, guns drawn, and demand that you…

In each case, if you defend yourself with deadly force, if you can’t prove that you could not retreat safely, you may be forced to defend yourself a second time in a courtroom. Under New Hampshire law, except in your home or its curtilage, you must retreat before you can defend yourself; Senate Bill 88 will allow you to defend yourself without retreating in any place you have a right to be.

You should not be forced to run from an attacker before defending yourself. SB 88 would fix the law so you don’t have to.

Another provision in SB 88 was specially crafted to prevent another person from being unjustly sent to prison for merely displaying a firearm.

SB 88 makes it clear that the display of a firearm to warn away trespassers is not criminal. Displaying, without firing a firearm, to protect your property should not land you in prison.

Unfortunately, despite the importance of SB 88 and despite your phone calls and emails, two Republican Senators who had voted for SB 88 only a few months ago, voted against overriding the Governor’s veto.

This has me worried.

You see, there was only one vote to spare when the Senate overrode the Governor’s veto.

I have already been informed that many State Representatives are feeling as much or more pressure to cave than was being put on the Senators before the vote.

I am concerned that without sufficient pressure from gun owners, many Representatives will cave in to the pressure from gun-grabbers to kill this bill.

I need you to call or email your State Representatives today!

The House could be voting on overriding the Governor’s veto as soon as this Wednesday.

I need your help.

With the vote in Senate being so close, I cannot take any chances that Representatives will switch their votes.

Despite passing the House last time with a super majority, every vote counts this time, and you and I cannot afford defection by even a few Representatives.

That is why I need you to email your State Representatives immediately!

Your State Representatives needs to be reminded that any State Representative who does not vote on the record to override the Governor’s veto of SB 88 will be considered a traitor to firearms owners.

If we want to see this important piece of legislation become law, we need to make sure every Representative who voted for SB 88 the first time, votes to override the Governor’s veto.

I need you to contact your State Representatives, tell them you don’t want their vote only when there is a wide majority. Tell them they need to vote in support of your right to self defense when it really matters, when every vote could be the deciding vote.

Please email your State Representatives today, it is crucial if we want to end the unjust requirement to retreat in the face of an attack.

You and I, together, can get this important legislation enacted, but I need you to act now!

Sincerely,
President, NHFC

P.S. It is crucial to the fight to overide the Governor’s veto of SB 88 that you call and/or email your State Representatives immediately. Your State Representative’s Contact information can be found on the House Website.

We can end the unjust duty to retreat, this is the last step, but we must act now!

I told you just a few days ago that Senators were beginning to buckle under the pressure from the anti-gunners.

Now some Senators are trying to set themselves up to blame you when they vote the wrong way.

It has become even more critical that you contact your Senator today!

Governor Lynch is holding a press conference today to try and bolster support for sustaining his veto on SB 88.

With less than 48 hours notice, over a holiday weekend, some legislators are trying to organize a counter press conference for later in the day.

Unfortunately, political insiders tell me that the purpose of that press conference is not to bolster support for overriding Governor Lynch’s veto of SB 88, but to provide cover for Senators to vote to sustain the Governor’s veto.

You see, some Senators are already saying that if gun owners don’t show up a massive crowd to this press conference, there won’t be enough votes to override the Governor’s veto.

They know that most gun owners will not be able to get off work in time to attend; they want to use a poor turnout as an excuse for not enacting SB 88 and ending the unjust requirement to retreat from an attack.

That is unacceptable.

They want you to waste hours of your day, and lose a day’s pay at work, to attend a meaningless press conference only to use poor attendance as an excuse for stabbing firearms owners in the backs.

You and I need to send a message to the politicians in Concord that that is unacceptable.

I need you to contact your Senator today; tell him that you elected him to represent you.

Tell your Senator that it doesn’t matter how many people show up to the press conference tomorrow, you expect him to do the right thing and vote to overturn the Governor’s veto of SB 88.

If you and I want to see the end of the duty to retreat, I need you to call or email your Senator today. You and I need to send a message that these political games will not work, that any Senator who does not vote on the record to override the Governor’s veto of SB 88 will be considered a traitor to firearms owners.

Read my last message about about SB 88 to help explain why it is so important to override the Governor’s veto.

SB 88 can still become law, but it is critical you act today!

In Liberty,

Jonathan R. Evans, Esq.
President, NHFC

PS. Please read the email I sent you a few days ago, explaining why the Governor’s veto of SB 88 needs to be overriden, and call and/or email your Senator immediately, and tell him the games won’t work; you expect him to vote in favor of overriding the Governor’s veto of SB 88 regardless of the outcome of the press conference later today.

Earlier this summer I asked you to contact your Senator and tell them to force a committee of conference to fix the flawed Constitutional Carry provisions of SB 88.

Unfortunately, instead of fixing those provisions, the committee of conference removed the Constitutional Carry provisions of SB 88.

Despite the loss of the Constitutional Carry provisions SB 88 is a significant step forward for firearms owners.

Imagine walking to your car after a hockey game at the Verizon Arena, and two men pop out from behind a car, guns drawn, and demand that you.

Unfortunately, SB 88 has hit another hurdle.

Not surprisingly, Governor Lynch vetoed SB 88.

Until now, with veto proof majorities supporting SB 88 in both houses of the legislature, an override of the Governor’s veto seemed highly likely.

I wasn’t taking anything for granted, though, and was watching the process closely. Now my sources in Concord are confirming my suspicions. When passage by a wide margin seemed likely, Senators didn’t hesitate to add their votes to an already large majority, but now, when every vote counts as we seek to override the Governor’s veto, some Senators are beginning to buckle under pressure from the gun grabbers.

The gun grabbers know that this is their last chance to stop this important piece of legislation and are trying everything they know how to stand in the way of your right to defend yourself.

I need your help.

If we want to see this important piece of legislation become law, we need to make sure every Senator who voted for SB 88 the first time, votes to override the Governor’s veto.

I need you to contact your Senator, tell them you don’t want their vote only when there is a wide majority. Tell them they need to vote in support of your right to self defense when it really matters, when every vote could be the deciding vote.

Please email your Senator today, it is crucial if we want to end the unjust requirement to retreat in the face of an attack.

You and I, together, can get this important legislation enacted, but we must act now!

Sincerely,

P.S. It is crucial to the fight to overide the Governor’s veto of SB 88 that you call and/or email your Senator immediately. Your Senator’s Contact information can be found on the Senate Website
